The College of Law discusses a doctoral thesis on the requirement of the contract
The Faculty of Law, University of Karbala, discussed the doctoral thesis tagged “Required Contract – A Comparative Study”, the thesis submitted by the student: Rasim Ayed Hassan.
The thesis aimed at clarifying the importance of the subject of the contract requirement within the scope of the rules of civil law, as it is related to its basis to the content of the essential or original contract, as each contract has its content, and the basic provisions that distinguish it from other contracts, or as it is expressed in the distinctive character of that contract, this content or That main characteristic is embodied by the requirement of the contract.
The thesis also showed that the contract requirement means the subject of the contract in terms of its real or essential content, in addition to the obligations of the contract on the contracting parties.
The researcher reached a number of results and recommendations, the most important of which is that the Iraqi civil law did not address the requirement of the contract, and did not expressly indicate its applications referred to above. So the subject of our research came to determine what is meant by (the requirement of the contract) as well as to indicate its applications and determine the penalty for its violation represented by setting contradictory conditions or Contrasting it, especially that the contract is one of the important means to achieve the requirements of the individual and satisfy his needs, so it is not possible for the individual in the light of the current development to satisfy his needs alone, and therefore the contract is his means to achieve this at the level of legal and economic relations.
